By using this site, located at https://www.DigitolServices.com (the “Site”), you agree to be bound by and comply with these Terms and Conditions unless different terms are agreed to in writing by the Company.

By visiting the Site, purchasing services, or contacting us, you agree to receive communications from us electronically. We may communicate via email, phone, or updates to the Site. You consent to receive such communications electronically and agree that they satisfy any legal requirement for written communication.
Use of the Site is intended for individuals 18 years or older. If you are a Minor, you may only use the Site under the supervision of a Guardian. By using this Site, you warrant that you are at least 18, are using your true identity, and will keep your account information accurate and current.
All payments must be made by credit card or ACH transfer. Executive & Strategic Solutions, LLC (doing business as Digitol Services) does not offer credit terms, invoicing, or deferred payments. Service access, including content hosting and CMS access, will be suspended immediately upon failed or discontinued payment. Orders are binding only upon acceptance by the Company.
Executive & Strategic Solutions, LLC does not accept returns or provide refunds once services are rendered or digital content is delivered. Subscription fees are non-refundable, including for partial months or unused portions of service periods.
All original content, creative materials, or other deliverables (“Digitol Content”) created by Executive & Strategic Solutions, LLC as part of your subscription remain the intellectual property of the Company. The Company grants you a non-exclusive, non-transferable, revocable license to use Digitol Content solely while you maintain an active, paid subscription. If your subscription is canceled or lapses, this license immediately terminates, and you must cease using any Digitol Content in new or ongoing materials.
Any content that you upload, provide, or create within the Digitol CMS platform (“Client Content”) remains your property at all times. You retain full ownership rights to Client Content, including content salvaged or migrated from prior websites or systems. The Company does not claim ownership of Client Content but may host, store, or display it as necessary to provide services under your active subscription.
Your use of the Site and Services is at your sole risk. All services are provided on an “as is” and “as available” basis. Executive & Strategic Solutions, LLC disclaims all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant uninterrupted, error-free, or virus-free operation of the Site or Services.
In no event shall Executive & Strategic Solutions, LLC, its officers, employees, or affiliates be liable for any indirect, incidental, or consequential damages, including loss of profits, goodwill, data, or other intangible losses, even if advised of such possibility. Our total liability for any claim shall not exceed the amount paid by you to the Company within the twelve months preceding the claim.
You agree to indemnify and hold harmless Executive & Strategic Solutions, LLC, its officers, employees, and affiliates from any claims, damages, or expenses, including attorney’s fees, arising from your use of the Site or Services.
All marks, trade names, and graphics associated with Digitol Services are the property of Executive & Strategic Solutions, LLC. Clients retain ownership of their own Client Content. Any continued use of Digitol Content after termination constitutes infringement of the Company’s rights.
The Company reserves the right to modify, suspend, or discontinue any Product, Service, or Promotion under the Digitol Services brand at its sole discretion. If the CMS or any part of the service is discontinued, clients with active subscriptions will have an opportunity to export their data and Client Content before deactivation.
This Agreement is governed by the laws of the State of Tennessee. Any dispute shall be brought in the state or federal courts of Williamson County, Tennessee. You consent to such jurisdiction and waive any objection based on venue or convenience.
Digitol Services is a brand owned and operated by Executive & Strategic Solutions, LLC, headquartered in Tennessee, USA. All agreements, billing, and legal obligations are between you and Executive & Strategic Solutions, LLC.
If any provision of these Terms is held unenforceable, the remaining provisions will continue in effect. These Terms constitute the entire agreement between you and the Company regarding the subject matter herein.
